Terms of Service

1. Acceptance of Terms

By creating an account or using Lancero, you agree to these Terms of Service. These Terms work alongside Apple's Standard End User License Agreement (EULA) — linked from Settings and on the App Store listing — which also governs your use of the app. If you do not agree, do not use the app. We may update these terms from time to time. Continued use after changes constitutes acceptance of the revised terms.

2. About Lancero

Lancero is a personal cigar-collection, humidor, and tasting-journal app operated by Simena Digital LLC, a Wyoming limited liability company. It lets you scan a cigar band to identify it, track humidors and their humidity, log tasting notes and ratings after every smoke, and keep a wishlist. Lancero does not sell cigars, cigar accessories, or any tobacco product, and does not facilitate any purchase, sale, or trade of tobacco between users or with any third party — it is a private tracking and journaling tool only.

3. Account Registration

You create an account using Sign in with Apple. You must provide accurate information and keep your credentials secure; you are responsible for all activity under your account. You must be at least 17 years old to use Lancero.

4. Subscription & Payments

Lancero requires a subscription to add, edit, or scan cigars — there is no free tier for building your collection. Purchases are billed through Apple In-App Purchase, and the exact price for each plan is shown in your local currency on the App Store subscription screen before you confirm a purchase.

• Weekly plan: billed once per week, and includes a 3-day free trial for first-time subscribers.
• Yearly plan: billed once per year, and includes a 7-day free trial for first-time subscribers.
• Free trials are limited to one per subscription group: if you have already used the trial on one plan, the other plan starts as a paid subscription immediately. The purchase screen always shows the exact terms that apply to you before you confirm.
• Both plans automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. If you don't cancel before a trial ends, the plan converts to a paid subscription and your payment method is charged.
• You can manage or cancel your subscription any time in your iOS Settings, under your Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period — you keep access until then.
• Refunds are handled by Apple according to their refund policy — we do not process refunds directly.
• Prices may vary by region and are displayed in your local currency in the App Store.
• Restore Purchases is available on the paywall and in Settings, and reattaches your Apple ID's existing purchase to your account.

5. User Content

You own the humidors, collection entries, journal entries, wishlist items, and photos you create in Lancero. Your collection is cached on your device for fast, offline browsing, and synced to our servers so it's there when you sign in on another device — see our Privacy Policy for what's stored and for how long. By using Lancero, you grant us a limited license to store and process this content for the purpose of providing the service to you (syncing your collection, running the identification feature, and enforcing subscription entitlements).

You are responsible for the content you create. Do not use Lancero to store or share content that is illegal, harmful, or infringes on others' rights. You may delete any item, or your entire account, at any time from Settings within the app (see §11).

6. Cigar Identification Feature

Lancero's scan feature uses an AI model to suggest a brand and line from a photo of a cigar band. Suggestions are informational only, may be incorrect or incomplete, and are not a substitute for your own knowledge or judgment — always verify what you're smoking against the band, box, or your own records before relying on it. The feature has a daily use limit to keep the service sustainable for everyone.

7. Third-Party Content and Services

Lancero integrates with the following third-party services:

• Apple: Sign in with Apple for authentication, and In-App Purchase for billing.
• Anthropic: powers the cigar-band identification feature (see §6 and our Privacy Policy §3).
• RevenueCat: subscription billing and entitlement management.
• Sentry: crash and error reporting, when enabled.

Each provider's own terms and privacy policy apply to those interactions. Lancero does not display third-party advertising and does not sell user data.

8. Acceptable Use

You agree not to:

• Use Lancero for any unlawful purpose, including any purpose related to the sale or distribution of tobacco
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the service
• Reverse engineer, decompile, or disassemble the app
• Use automated means to access the service (bots, scrapers)
• Impersonate another person or misrepresent your identity
• Submit content designed to harm, harass, or threaten others
• Upload malicious content or code

9. Intellectual Property

Lancero, including its design, code, features, and branding, is the intellectual property of Simena Digital LLC. You may not copy, modify, distribute, or create derivative works based on Lancero without our written permission.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Simena Digital LLC and its officers, employees, and agents shall not be liable for:

• Any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of Lancero
• Inaccurate, incomplete, or mistaken cigar-identification suggestions (see §6)
• Loss of collection data, journal entries, or photos due to device failure or user error
• Service interruptions, downtime, or data loss
• Issues arising from third-party services integrated with Lancero

Lancero is provided "AS IS" without warranties of any kind, express or implied. Our total liability to you for any claims arising from or related to Lancero shall not exceed the amount you paid for the service in the 12 months preceding the claim.

11. Account Termination

You may delete your account at any time from Settings within the app. Deletion is soft-applied immediately — your active session is ended and your Apple refresh token is revoked — and finalized after 30 days. During this 30-day grace window you may restore your account by signing in again with the same Apple ID. After 30 days, your account, humidors, collection, journal entries, wishlist, and uploaded photos are permanently and irreversibly deleted.

We reserve the right to suspend or terminate accounts that violate these terms, engage in abusive behavior, or pose a security risk to other users or the integrity of the service.

12. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of Lancero shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
